In this blog post, we’ll examine the causes of sudden acceleration accidents, the current legal and technical issues surrounding them, the responsibilities of drivers, manufacturers, and the government, and the direction for necessary institutional reforms moving forward.
Around April 2009, an acquaintance of mine was involved in an accident suspected to be caused by sudden acceleration. It had been less than a month since he had purchased the new car. As he entered an underground parking garage and attempted to park, he stepped on the brake, but the vehicle did not stop. Instead, with a loud “whoosh,” it surged forward, crashed into a wall, then reversed and collided with a pillar; he said he experienced a terror he would never forget. Ultimately, he filed a lawsuit against the automaker, but the court ruled that it was a driver error and he lost the case. He insisted that he had definitely not mistakenly pressed the accelerator pedal, but his claim was not accepted.
Accidents involving sudden unintended acceleration continue to be a subject of social controversy. Even recently, civil court rulings in South Korea that have directly acknowledged sudden unintended acceleration have been extremely rare, and in most lawsuits, the manufacturer’s liability has not been recognized on the grounds that a vehicle defect was not sufficiently proven. Interviews with drivers who claim to have experienced sudden acceleration often reveal that their memories of the incident were terrifying, and there are many cases where they suffer from long-term psychological trauma following the accident. Reports of suspected sudden acceleration continue to be filed with the police and relevant agencies. Although this issue has been raised for a long time since the widespread adoption of electronic control technology in automobiles, the social controversy persists, and differences of opinion regarding the cause of the accidents remain unresolved. Given this situation, both the government and manufacturers need to establish an investigation system and institutional reforms that the public can trust.
The controversy over sudden acceleration in vehicles began in earnest as automotive electronics became more widespread. Today, most cars are equipped with various electronic control devices, and systems ranging from ABS to ESC, electronic throttle control, and various driver-assistance systems are largely controlled by computers. Automotive electronic control refers to a system in which various sensors and the ECU (Electronic Control Unit) analyze and control the driver’s inputs. This enables far more precise control than in traditional mechanical vehicles—allowing for more accurate regulation of fuel injection and ignition timing, improved braking performance and driving stability, and the maintenance of vehicle posture even on slippery roads. Such electronic control technology is now an indispensable core technology in the automotive industry.
However, as automobiles have evolved from mechanical to electronic systems, we have entered an era where the possibility of electronic device malfunctions must also be considered. Since various elements—such as the ECU, various sensors, wiring, and software—operate in a complex interplay, there is a possibility that the vehicle will not function normally if a problem occurs in any one part. However, to date, there has been no scientific consensus that allows us to generalize and conclusively state that sudden acceleration is caused by a specific ECU malfunction. In actual accidents, multiple possibilities—including driver error, mechanical defects, and electronic control malfunctions—are investigated simultaneously. Therefore, when a sudden acceleration accident occurs, it is of the utmost importance to comprehensively analyze the vehicle’s various records and the circumstances at the time of the accident.
The problem is that it is extremely difficult to clearly prove the cause of the accident. While some argue that restarting the engine after an accident may cause some temporary error data to disappear, vehicles actually store various diagnostic records and accident logs. A prime example is the EDR (Event Data Recorder). An EDR is a device that records various pieces of information—such as the vehicle’s speed, whether the brakes were applied, and accelerator pedal input—immediately before and during an accident. However, the scope of the recorded information and the methods of analysis vary by manufacturer, making it difficult for the average consumer to interpret the data directly. For this reason, controversy surrounding the determination of accident causes continues.
Recently, the scope of EDR data utilization in vehicle accident investigations has been gradually expanding. Nevertheless, controversies persist regarding manufacturers’ analysis methods and the scope of information disclosure. Many countries, including the United States, actively utilize EDR data in accident investigations, and in South Korea as well, discussions continue regarding improvements to relevant regulations and expanding access to this information. To determine whether sudden acceleration occurred more objectively, it is crucial to establish a transparent analysis system that manufacturers, investigative agencies, and consumers can all trust.
In light of this situation, many drivers are installing separate dashcams that record the pedal area. This is because such footage allows investigators to verify whether the driver actually pressed the brake or the accelerator at the moment the accident occurred. Of course, a pedal dashcam alone cannot definitively determine the cause of every accident, but it can serve as important evidence for objectively verifying the driver’s actions at the time of the accident. In fact, there has been a gradual increase in cases where such footage is being used as reference material during accident investigations.
However, simply expanding the use of EDR data or installing pedal dashcams cannot completely prevent sudden acceleration accidents on their own. Automotive technology continues to advance, and manufacturers are constantly making software improvements and hardware enhancements to increase vehicle safety. Nevertheless, as accidents suspected of being caused by sudden acceleration continue to occur, manufacturers must continue to disclose information more transparently and make proactive efforts to improve technology, while the government must also continuously refine objective investigation systems and consumer protection measures.
The electrification of automobiles is at the core of modern automotive technology. Therefore, it is practically impossible to abandon electronic control technology altogether. It is difficult for any software to perfectly predict all exceptional situations, and vehicles are also exposed to various environmental factors such as high temperatures, vibrations, humidity, dust, and impacts. To ensure maximum safety under these conditions, manufacturers are continuously advancing dual- and triple-redundant safety designs and error-detection systems. Going forward, the development of even higher levels of safety technology—in both hardware and software—will be necessary.
Some have proposed adding mechanical emergency devices. For example, there are suggestions to introduce emergency functions that can forcibly cut off the vehicle’s power or disconnect the drivetrain. However, the approach of reinstalling the clutch pedal—as was done in the past with manual transmission vehicles—is unlikely to be a practical alternative given the current structures of automatic transmissions and electric vehicles. Instead, developing new emergency safety devices tailored to the vehicle’s structure is considered a more realistic approach.
Currently, most passenger cars use automatic transmissions or electric vehicle architectures, and returning to the traditional manual transmission method is practically impossible. Therefore, to reduce accidents suspected of being caused by sudden acceleration, it is even more important to establish highly reliable electronic control systems, objective accident data recorders, and an investigation system that anyone can accept in the event of an accident.
We have examined various issues surrounding sudden acceleration accidents in automobiles. Manufacturers must strive for continuous technological development to further enhance vehicle safety and provide transparent information, while the government must steadily improve the objective accident investigation system and related regulations. Furthermore, it would be helpful for drivers to properly understand their vehicles’ safety features and, if necessary, utilize additional safety devices such as pedal black boxes. Above all, it is crucial to establish an environment where the causes of accidents can be objectively determined to prevent any victims from suffering unjustly. Only when systems and technologies that manufacturers, the government, and consumers can all trust develop in tandem will the controversy surrounding sudden acceleration in vehicles be resolved more reasonably.
